Trade Post 47 Online Shop General Terms and Conditions (Version: May 23, 2023)

Scope

These terms and conditions apply to all current and future business relationships. Deviating, different, or additional terms and conditions, even if known, do not become part of the contract unless expressly agreed upon in writing by us.

Offer and Order

The Trade Post 47 offer serves as information and does not constitute a legally binding offer. The content is intended exclusively for end customers. By placing an order, the buyer/contracting party confirms the use and utilization of the goods for private purposes.

Trade Post 47 offers are generally non-binding. Technical changes as well as changes in form, color, and/or weight are reserved within reasonable limits. Ordered and delivered goods remain the property of Trade Post 47 until full payment of all claims from an ongoing business relationship. Place of performance and jurisdiction is the company's registered office.

Prices and Payment Methods

All prices stated are gross prices including statutory value-added tax plus shipping costs. Unless otherwise stated, the prices refer to the respective items depicted in the description, but not to accessories. The prices according to the online shop's current daily prices at the time of ordering apply. We do not assume any liability for printing and/or typing errors in the price information.

We reserve the right to adjust prices (if necessary, on a daily basis). Internet prices include the applicable value-added tax in Austria for deliveries within the EU at the time of ordering.

Payment can be made via Credit Cards, Debit Cards, PayPal, EPS, Klarna, Giropay and advance payment (bank transfer), as well as cash payment upon collection. If items are ordered specifically at the customer's request from our suppliers, such items are excluded from return and/or exchange. All items and goods remain the property of Trade Post 47 until full payment is received.

Delivery

We deliver as quickly as possible and ship within a few days if the products are marked as in stock.
The online shop allows for placing orders for some products even if the respective item is not currently in stock. If an item is not in stock, you will promptly receive an email or a call from us to clarify the individual case directly and quickly. We may not always be able to avoid delivery delays.

The shipping costs are calculated based on size and weight.
Small parts are shipped in an envelope, while bulky goods require special transportation.

Product Characteristics

Only the product description provided by the manufacturer is considered the agreed-upon nature of the goods. The scope of delivery is in accordance with our description. Public statements, advertisements, or promotional material by the manufacturer do not constitute a contractual nature of the goods.

Warranty

Trade Post 47 provides you with the statutory warranty for any material and manufacturing defects on all items. No further guarantees or warranties are granted.

If delivered items have obvious material or manufacturing defects, please immediately notify us of such defects in writing. The warranty is limited to the products themselves and does not cover consequential damages, loss, intentional damage, and improper handling. For defects in the goods themselves, Trade Post 47 will, at its discretion and subject to the legal requirements, either remedy the defect or provide a replacement delivery. We do not provide warranties in the legal sense. Manufacturer warranties remain unaffected. Claims under the Product Liability Act are deemed inadmissible by both parties when ordering through the online shop, by telephone, or in writing. Unsolicited returns or returns without an RMA number (issued by us) will not be accepted by us!

Withdrawal - Right of Revocation - Returns - Refunds

You can return goods ordered online within 14 days from receipt without giving any reasons.
No right of revocation exists for goods that have been made or customized to customer specifications.
The costs for the return shipment are to be borne by the customer.

If there is a decrease in the value of the goods due to handling that is not necessary for examining their nature, characteristics, and functioning, the customer must pay compensation for the decrease in value.

Improvements and Changes

Trade Post 47 reserves the right to make product improvements that, in our opinion or in the opinion of the manufacturers, serve to improve quality, even without prior notice. The prices stated are valid until further notice. We expressly reserve the right to make errors and typographical mistakes in product descriptions and prices.

Copyright

The Trade Post 47 offering is subject to the copyright of Trade Post 47. Trade Post 47 expressly reserves ownership and copyright to the offers. Linking or use for personal purposes is only permitted with the prior written consent of Trade Post 47.

Payment Default

In case of payment default, we are entitled to charge reminder fees and default interest. From the 2nd reminder onwards, significant costs will be incurred for the non-payer. If no payment is made, a debt collection agency will be instructed to collect the claim. In case of default, the contracting party is obliged to reimburse Trade Post 47 for the reminder and collection expenses incurred, plus default interest. The goods remain the property of Trade Post 47 GmbH until full payment is received.
